In this country the woman would've been sent to prison for at least five years for the crime she commited.

Me I would have executed her. And not that fancy "we'll make you wait 15 years in a state condo (ie prison) and then we'll gently give you a lethal injection"... no, no: 5 minutes after judgement, we'd bring the guilty outside the courthouse, place him on his knees and fire a bullet in his head.

That would make many think twice before drinking and driving.

Of course that doesn't factor in the "he/she needed killing" clause, in wich one must prove beyond any shadow of a doubt (with graphs and charts) that the world is now a better place now that you killed that person. This would allow us to rid ourselves of rapests, priests, Michael Jackson Fans, and telemarketers.

In the world of Emperor First the First, drunk drivers who did NOT kill anyone would be beaten to within an inch of their lives.

Drunk drivers who DID kill someone would be fragecuted.

Fragicution: Execution, in a spectacularly loud, bloody and violent manner, as opposed to accepted "humane" methods such as lethal injection. Also, First of Two's preferred punishment for those who abuse children.

Examples:
Explosive decompression.
Death of a Thousand Lawn Darts.
Orbital keelhauling.
The Sixteen-Ton Weight.

Wow, now I see what the fuss is about.

In my view:

1) She should have been tried on multiple counts of vehicular manslaughter with a garnish of other offenses. Screw, (pardon me), a plea bargin.

2) I think the judge ought to get a nice long prison sentence himself and/or be forced to ride with the local coroner on all traffic accidents, loading the bodies himself.

3) I would not impose the death penelty, rather she would be responsible for the financial support of the orphan. (If I could make it work, I would make her responsible for raising the child).

4) People who drive and use cell phones should be forced to eat the phone. (That's my fascist statement )

Fortunately, America has a law against "cruel and unusual" punishment. So, the concentration camps you folks have planned for the criminal element aren't coming to pass. Besides, making a criminal suffer unusually will not undo the crime nor will it make the victims feel better about their losses. Law is about justice not revenge. (Yes, there is a difference.)

I do agree, however, that jail time is very appropriate in this incident and should not have been plea bargained down. (Maximum sentence for involuntary manslaughter sounds right . . . depending on local statute, of course.)

As for having the criminal raising the child left behind: Would you really condemn the child to be raised by such an irresponsible person ? I certainly wouldn't. ComaBoy's other ideas certainly have merit, though.

i have now twice.
lost friends-more than you can imagine.

revenge/justice-it's all how you word it..and it does make you feel better, been there done that and most likely do it again with the way the world at large is currently.

There are a few guidelines I'd like to see adopted by all North American jurisdictions...

A crime like vehicular homicide or assault or whatever, committed under the influence of alcohol, should automatically be jumped up a notch to "aggravated" or "with special circumstances" (or whatever phrase is used in the particular jurisdiction).

Lifetime driving suspensions on repeat DUI offenders.

one of my friends father had 9 yes 9 dui violations, he ended up getting killed one day while walking home drunk, the resulting crash still resulted in death of a passenger.

friends take friends home-
one of the regulars at the bar took home his friend who was too drunk to drive-unfortunately he was also a tad bit drunk hit another car and killed the friend he was taking home-
he got probation and loss of drivers liscence for life-oooo big sentence- the crash caused his eyesight-(he's going blind and laser surjury only gave 20% back) to be too bad for driving anyway.

In a world where so much seems to be 'disposable' i.e. income, feelings etc.. it seems only right that those who have been caught up (read taken-in) by the culture of me, now and immediate, have an opportunity (?) to pause and be reminded of what is caused by this mind-set that it appears they have been sucked into. I, for one, am all for the guilty being reminded at every opportunity (that is if their conscience is malfunctioning and does not do it for them) of the grief and waste that their actions cause, even if it is a 'small' gesture (wrong word I know) of carrying the photograph of someone they have killed.

Small point - typical of today's society, where this kind of punishment is objected to by a lawyer..... the words 'do they expect to get off scot free' spring to mind...
